Terms of Service

These Terms are an agreement between you and the operator of Tidewatcher ("Tidewatcher", "we", "us"). By creating an account or using tidewatcher.app (the "Service") you agree to these Terms, our Privacy Policy, Risk Disclaimer and Refund Policy below. If you don't agree, don't use the Service.

1. Who can use Tidewatcher

You must be at least 18 years old and legally able to enter a contract. You may not use the Service where doing so is illegal, or if you are on a sanctions list or located in a sanctioned country.

2. What the Service is

Tidewatcher shows market data, on-chain token data, social media posts, prediction-market odds, memes, automated scores (such as "Heat") and automated safety checks, all gathered from third-party public sources. It is a research and information tool only. We do not give investment, financial, legal or tax advice, we are not a broker, exchange or registered investment adviser, and we never hold, trade or move your funds. Nothing in the Service is a recommendation to buy, sell or hold anything.

3. Your account

Keep your password secure; you're responsible for activity on your account. One account per person — don't share, resell or rent access. Tell us right away at [email protected] if you think your account was accessed without permission.

4. Subscriptions and billing

5. Acceptable use

You agree not to: scrape, copy or resell the Service or its data; reverse-engineer it or bypass plan limits or security; overload it or use bots against it; use it for anything illegal, including market manipulation, fraud or "pump and dump" schemes; or use the Tidewatcher name to suggest we endorse any token or person.

6. Third-party content

Posts, tokens, links, prices and other content shown in the Service come from third parties (for example X/Twitter accounts, DexScreener, CoinGecko, GeckoTerminal, pump.fun, Yahoo Finance, Polymarket, Reddit, RugCheck and GoPlus). We don't control, verify or endorse them, and listing an account or token is not an endorsement. Accounts we suggest following may be paid to promote tokens. Your use of third-party sites is governed by their terms.

7. Our content

The Service, its design, code, scores and branding belong to us. We give you a personal, non-transferable, revocable licence to use the Service for your own research while your account is in good standing.

8. Alerts

Telegram and Discord alerts are best-effort. They can be late, missed, duplicated or wrong because of outages, rate limits or data errors. Never rely on an alert as your only source for a decision.

9. Suspension and termination

You can stop using the Service and cancel at any time. We may suspend or close accounts that break these Terms, abuse the Service, or that we're required to close by law. If we close your account without cause, we will refund the unused part of your current paid period.

10. Disclaimer of warranties

The Service and all data are provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, completeness, timeliness, merchantability, fitness for a particular purpose and non-infringement. We don't guarantee the Service will be uninterrupted or error-free, or that any safety check will detect a scam.

11. Limitation of liability

To the fullest extent allowed by law, Tidewatcher and its operators will not be liable for any trading or investment losses, lost profits, lost data, or any indirect, incidental, special, consequential or punitive damages, however caused, even if advised of the possibility. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50.

Some places don't allow these limits, so they may not fully apply to you.

12. Indemnity

You agree to cover our reasonable costs and losses from claims by others arising out of your misuse of the Service or your breach of these Terms.

13. Disputes

Please contact us first — most problems can be solved by email within 30 days. If not, any dispute will be resolved by binding individual arbitration under the rules of the American Arbitration Association (consumer rules), except that either side may bring an individual claim in small-claims court. You and we waive the right to a jury trial and to take part in class actions. You may opt out of this arbitration section by emailing [email protected] within 30 days of creating your account.

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Nothing here limits rights you have under consumer-protection laws where you live.

14. Changes

We may update these Terms. For material changes we'll email you or show a notice at least 14 days before they take effect. Continuing to use the Service after that means you accept the new Terms.

15. Other

If any part of these Terms is unenforceable, the rest still applies. Not enforcing a term isn't a waiver. You can't transfer these Terms; we can, as part of a sale or reorganisation of the Service. These Terms are the whole agreement between us about the Service.

Privacy Policy

We collect as little as we need to run the Service. We don't sell or rent your personal data, and we don't use advertising trackers or analytics cookies.

What we collect

Cookies

We use tw_session, a strictly necessary cookie that keeps you logged in. If you arrive through a creator's referral link we also set tw_ref for 30 days, which only records which creator sent you so they can earn a commission if you subscribe. No tracking or advertising cookies are used. Fonts are loaded from Google Fonts, which means Google receives your IP address when pages load.

Why we use it

To provide your account and plan, process payments, send the alerts you set up, prevent abuse and fraud, and meet legal obligations. (For EU/UK users: legal bases are performance of a contract, our legitimate interest in security, and legal obligation.)

Who we share it with

How long we keep it

While your account is open. After you ask us to delete your account we remove your data within 30 days, except billing records we must keep for tax and accounting (usually up to 7 years, held by Stripe).

Your rights

You can ask to access, correct, download or delete your data, or object to how we use it, by emailing [email protected] from your account email. We'll respond within 30 days. California residents: we don't sell or share personal information for cross-context advertising. EU/UK residents may also complain to their local data protection authority.

Security

Passwords are hashed, sessions are stored only as hashes, traffic is encrypted with HTTPS, and access to the database is restricted. No system is perfectly secure; we'll notify you if a breach affects your data as the law requires.

Children

The Service is not for anyone under 18 and we don't knowingly collect their data.

Changes

We'll post updates here and email you about material changes.
